According to Article 14 of the Swiss Data Protection Act (FADP), companies with their registered office outside Switzerland are obliged to designate a representative in Switzerland if they process personal data of persons in Switzerland under the following conditions: (1.) the data processing is carried out in connection with the offer of goods or services or in the context of behavioural monitoring (e.g. online tracking) in Switzerland and (2.) the data processing is extensive and regular and involves an increased risk to the personality of the persons concerned. By law, the representative under the FADP serves as a point of contact for the data subjects and the Federal Data Protection and Information Commissioner (FDPIC).
